Modeller Terms and Conditions

IMPORTANT: By placing an order on modeller.ca, you confirm that you have read, understood, and agreed to these Terms and Conditions in full. Please read carefully before purchasing.

Agreement to Terms

When you select a product or service and follow the checkout process on modeller.ca, you are entering into a legally binding contract with Modeller (“we,” “us,” or “our”) on these Terms and Conditions.
By completing your purchase, you expressly confirm that: (a) you have read and understood these Terms; (b) you meet any eligibility requirements for the products ordered; and (c) all information you have provided is accurate.
A mandatory checkbox confirming acceptance of these Terms is presented at checkout. Orders cannot be completed without this confirmation. Records of your acceptance, including your IP address, browser details, and timestamp, are retained.

Made-to-Order Products & Sales Policy

All Modeller products are custom, made-to-order items. Production begins immediately upon receipt of full payment. Because each product is manufactured specifically for you, all sales are final and we do not offer cancellations or refunds once an order has entered production.
By placing an order, you acknowledge and accept that: (a) your order is custom-manufactured to your specifications; (b) production commences upon payment; (c) cancellations are not possible once production has begun; and (d) you have verified your order details, including product selection, quantities, and shipping address, before submitting.
In the limited circumstances described in Section 4 (Damaged or Incorrect Items), we will provide a repair or replacement. This does not affect your statutory rights under applicable Canadian law.
Items ordered in error cannot be returned or exchanged. Please review your order carefully before completing checkout.

Payment & Pricing

Your order must be paid in full before we begin production. We will not commence manufacturing until payment is confirmed.
All prices on modeller.ca are displayed in CDN and exclude applicable sales tax. Shipping charges and taxes will be calculated and displayed during checkout before you submit your order.
We reserve the right to decline all or part of any order for any reason. If we decline your order after payment has been received, we will issue a full refund within a reasonable timeframe and notify you with details.
Your credit card issuer, bank, or financial institution may charge fees for international transactions. We have no control over and are not responsible for such fees.

Damaged or Incorrect Items

We take quality seriously. If your order arrives damaged or contains incorrect items, please follow the steps below. Failure to follow these steps may limit our ability to assist you.

At the Time of Delivery

If any boxes appear damaged during delivery, note this on the courier’s paperwork before signing and photograph the damaged boxes before opening them.

Open all boxes immediately upon receipt and inspect the contents.

If items inside are damaged in transit, photograph the damage and notify us within 48 hours of receiving your order.

Missing Items

If an item is missing from your order, notify us within 48 hours of delivery. Replacement items will be shipped at no additional delivery charge to you.

Returns for Damage

Parts damaged during shipping may be returned within 30 days of delivery for a free replacement.

You are responsible for return shipping costs unless we arrange a courier pickup.
We reserve the right to inspect all returned products to confirm they comply with this policy before issuing a replacement. We may refuse a return if inspection reveals the item does not qualify under this policy.
Once we receive damaged or incorrect items back at our Vancouver location, we will repair or replace them promptly.

Shipping & Production Times

All orders are shipped from our Vancouver, Canada location following production. While we will provide an estimated shipping timeframe at the time of order, we cannot guarantee a specific ship date as each order is produced in the sequence received.
If your order is significantly delayed beyond our initial estimate, we will contact you proactively. If you have not received shipping confirmation within 90 business days of your order date, please contact us.
We will charge shipping costs for your delivery. All orders ship from Canada after local customs clearance. You may be responsible for import duties, taxes, and customs fees imposed by your country’s government. We have no control over these fees. If you are unsure of your obligations, contact your local customs office before ordering.
You are the importer of record and must comply with all applicable laws and regulations of the country where you are receiving the goods.

Dispute Resolution – Required Contact Before Chargeback

We are committed to resolving any concerns quickly and fairly. Before initiating any chargeback, payment dispute, or third-party claim with your financial institution or card network, you agree to contact us first and allow us a reasonable opportunity to resolve the issue.
To raise a concern, contact us at info@modeller.ca within 14 days of the issue arising. We will respond within 3 business days and work with you in good faith to reach a resolution.
Initiating a chargeback without first contacting us, where the dispute could reasonably have been resolved directly, may be considered a breach of these Terms. We reserve the right to contest any such chargeback and to provide all relevant evidence of this agreement and your acceptance of these Terms to your financial institution.
Nothing in this clause limits your statutory rights under applicable consumer protection law.

Product Characteristics & Natural Variation

As our product range evolves, there may be minor differences between products shown or described on our website and those delivered. While we aim to produce parts for older components, we cannot guarantee availability of all components or parts at all times.
Colour and finish may vary slightly depending on material batch and manufacturing conditions.
Our products are made from real wood and may contain small natural knots. These are not defects — they are part of the natural character of the material. Each piece is unique.

Wood should not be exposed to heat or excessive moisture.
Wood will darken naturally when exposed to sunlight over time. We recommend rotating or moving items on surfaces during the early months of use.
Electrical equipment can generate heat. Use a stand or mat to protect surfaces.

Installation, Safety & Proper Use

Cabinet tops are not intended to bear weight. Please use a shelf immediately above the cabinet for weight-bearing purposes. We are not responsible for damage caused by overloading cabinet tops.
The Modeller system must be installed precisely according to the installation instructions provided on our website. If instructions are not followed, the system may fail. We cannot be held liable for systems not installed per our instructions.
After the initial loading of shelves, periodically check that all screws remain secure and have not shifted.
We are not responsible for the pre-existing condition of walls, floors, or ceilings. We cannot be held liable for any failure in your wall or shelving system caused by pre-existing structural conditions.
The system must not be used as a ladder. No part of the system may be used to sit or stand on.

Website

We will operate this website with reasonable care and expertise, and make all reasonable efforts to rectify known faults promptly.
We do not guarantee uninterrupted availability of the website and disclaim liability for technical issues, bugs, viruses, or interruptions you may encounter while using it.
We make every effort to ensure that product information and pricing on the website are accurate and complete, but we are not responsible for errors or omissions. If a pricing error affects your order, we will contact you before proceeding.

Limitation of Liability

Our liability for personal injury or death resulting from our negligence is not limited or excluded by these Terms.
We will not be held responsible for loss or damage where: (a) the loss was not foreseeable by either party at the time the contract was formed; (b) the loss was not caused by any breach on our part; or (c) for non-consumer or business transactions, the loss exceeds the price of the products involved in the claim.
We will not be liable for circumstances beyond our reasonable control, including but not limited to acts of nature, war, civil or military authority, accidents, strikes, supply chain disruptions, or equipment failures.

Governing Law & Jurisdiction

These Terms are governed by the laws of British Columbia, Canada, and applicable federal Canadian law.
We will endeavour to resolve any disagreements promptly and fairly. If legal action is required, it must be commenced in British Columbia, Canada.

Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. We will provide reasonable notice of material changes, including by posting the updated Terms on our website and, where appropriate, by emailing registered customers at least 14 days before changes take effect.
Continued use of our website or placement of orders after the effective date of revised Terms constitutes acceptance of those changes.
