Terms of Service

  1. As each order is made-to-order, we cannot offer refunds. All sales are final.
  2. You can return parts that have been damaged during shipping within 30 days for a replacement. However, items ordered in error cannot be returned or exchanged.
  3. We reserve the right to inspect all returned products to ensure they comply with our return policy before issuing a refund. The buyer is responsible for shipping costs, and we may refuse a return based on our product inspection.
  4. When you select a product or service and follow the instructions on our website to place an order, you are entering into a contract with modeller.
  5. Your credit card issuer, bank, or financial institution may charge a fee for international transactions, and we have no control over these fees.
  6. We may decline all or part of any order for any reason, and we will contact you with details if this occurs. If we decline your order, we will issue a full refund if we have already received payment for the products.
  7. Your order must be paid in full before we begin production.
  8. While we may estimate the shipping time when you place your order, we cannot guarantee when your order will ship as we produce each order in the order received.
  9. If an item is missing from your order, please inform us within 48 hours of delivery, and you will not incur an additional delivery charge.
  10. If any boxes appear to have been damaged during delivery, please note this on the courier’s paperwork before signing and take photos of the damaged boxes before opening them.
  11. Please open the boxes immediately to check the contents. If the items inside are damaged during transit, please take photos and notify us of the damage within 48 hours of receiving your order.
  12. Once we receive damaged or incorrect items back at our Vancouver shop, we will repair or replace them.
  13. All prices on modeller.ca are shown in USD, excluding sales tax. Shipping and taxes will be displayed during checkout.
  14. As our products evolve, there may be some differences from those shown/described on our website. While we try to produce parts for older components, we cannot guarantee that all components or parts will be available.
  15. The colour and finish may vary slightly depending on the material.
  16. Although we strive to deliver the most consistent product, our products are made of real wood and may contain small knots that are part of the natural character of the wood, making each surface unique. Wood should not be subjected to heat or moisture, and it will darken naturally when exposed to sunlight. Therefore, it is advisable to move items on the surfaces during the early months of use. Electrical equipment can become hot in use, so it is recommended to use a stand or a mat.
  17. Cabinet tops are not intended to bear weight. Please use a shelf immediately above the cabinet for this purpose. We are not responsible for damage caused by overloading.
  18. If the installation instructions on our website are not followed precisely, the modeller system may fail, and we cannot be held liable for systems that are not installed according to our instructions.
  19. After the initial loading of shelves, please periodically check to see if any of the screws have moved.
  20. We are not responsible for the poor condition of walls, floors, or ceilings against which the system is installed, and we cannot be held liable for any subsequent failure in your wall or shelving system.
  21. The system must not be used as a ladder, nor can any part of the system be used to sit or stand on.
  22. We assure you that we will operate this website with reasonable expertise and care, and make all reasonable efforts to rectify any known faults.
  23. We do not provide any guarantees regarding the website’s availability, and we disclaim any liability for any technical issues, bugs, viruses, or interruptions that you may encounter while using it.
  24. We make an effort to ensure that the information on the website is accurate and complete, but we are not responsible for any errors or omissions that may occur.
  25. Modeller will not be responsible for any damages resulting from circumstances beyond its reasonable control, such as acts of nature, war, civil or military authority, accidents, strikes, or equipment failures, among other things.
  26. We reserve the right to modify these Terms and Conditions at any time without informing you, and such changes will be effective once we post the revised terms on the website.
  27. These terms are governed by Canadian law, and we strive to resolve any disagreements promptly and efficiently. If you wish to pursue legal action, you must do so in British Columbia, Canada, if you are unhappy with how we handle the dispute.
  28. We will charge you the shipping costs for your deliveries, and all orders will be shipped from Canada after local customs clearance. You may be responsible for local import duties, taxes, and customs fees imposed by your government. In some jurisdictions, you may be required to pay a tax in place of sales tax. We have no control over these fees and cannot predict their amounts. If you are unsure, please contact your local customs office.
  29. You are the importer of record and must comply with all laws and regulations of the country where you are receiving the goods.

  31. We will handle any complaints fairly, effectively, and confidentially, without affecting your consumer rights under the law.
  32. Our liability for personal injury or death resulting from our negligence will not be excluded by these terms and conditions.

We will not be held responsible for any loss or damage caused by us, our employees, or agents, provided that: (a) both parties did not foresee the loss or damage when the contract was formed; (b) the loss or damage was not caused by any breach on our part; or (c) the loss or damage pertains to business or non-consumer transactions, to the extent that it exceeds the price of the products involved in the claim.
